The San Marcos Planning & Zoning Commission is scheduled to vote today on whether to recommend that the city council re-open negotiations on the Lazy Oaks Ranch Development Agreement.

Since the agreement was approved last February, the investment group has acquired 635 acres adjoining 1,396 acres it already owned. The expanded, re-imagined project is now called “La Cima.”
The developers have proposed amendments to the original agreement that would expand land use entitlements to include 650 additional single-family units, for a total of 2,400 units; dedicate an additional 330.4 acres of open space or habitat preservation, for a total of 800.3 acres; and designate 200 acres at the high-traffic intersection of Wonder World Drive and Old Ranch Road 12 for future “general commercial” zoning.
Tonight’s advisory vote by planning commissioners would seem to be a relatively cut-and-dry decision compared to discussions that will follow. Should a majority of the commission vote against recommending renewed negotiations, the vote will not trigger a super-majority requirement for approval when it is considered by the city council next week as it would in rezoning cases.
The San Marcos City Council is scheduled to decide at its June 3 meeting whether it wants to revisit the contract with La Cima Development Group LP. If it does opt to do so, the city council can either appoint a subcommittee of three of its own members to lead negotiations with the developers or it can delegate the bargaining to city staff. Any amendments to the agreement would require approval by a city council majority without further input from the planning & zoning commission.
