Police: San Marcos man tried to nab woman outside H-E-B


A San Marcos man is behind bars after allegedly groping a woman outside the Kyle H-E-B and reportedly attempting to kidnap her moments after the woman finished shopping Saturday morning.

The woman’s fighting spirit, though, foiled the suspect’s alleged attempt to kidnap her just before noon.

“The victim began screaming for help and punching the male subject in the stomach. At that point, the male subject released the victim, returned to his vehicle and drove off toward H-E-B at a high rate of speed,” said Gilbert Dellossantos’ (De Los Santos) arrest affidavit.

De Los Santos was arrested March 31 and charged with attempt to commit aggravated kidnap with intent to inflict bodily injury or sexual abuse, a second-degree felony.

The victim told police she was emptying groceries from her shopping cart into the back of her car in the H-E-B Plus parking lot on the morning of March 30. The victim observed a black Toyota sport-utility vehicle park directly behind her, blocking her from backing out of her parking spot, the affidavit said.

That’s when De Los Santos got out of his car and approached the victim asking for directions to a church in the Green Pastures area of Kyle, the affidavit said, and as the victim attempted to offer directions, De Los Santos allegedly put both his hands down the victim’s dress, before allegedly grabbing her by the arm and attempting to pull her toward his vehicle.

The woman screamed for help and fought off her alleged kidnapper, who, she described to police, as Hispanic, 5-foot 10-inches in height and weighing about 300 pounds. She told police the suspect had a shaved head, dark patches of skin on his cheeks and a tattoo of an unknown design on his right arm.
The victim also was able to provide police with the Texas license plate number on the suspect’s vehicle, as well as a few identifying characteristics of the SUV.

Kyle Police tracked down the registration information from the vehicle’s license plate number and discovered the registered owner matched the verbal description provided by the victim, the affidavit said.

“I obtained a driver’s license photograph and completed a photo lineup,” a Kyle Police officer said in the affidavit. “The suspect was located in the number 4 position of the photo lineup. I then met with the victim at the Kyle Police Department. I provided the victim with the photo lineup, in which she picked the number 4 photo.”

Officers then contacted De Los Santos, who agreed to meet with authorities for a voluntary interview, the affidavit said.

During the course of the interview De Los Santos told police he visited the First Convenience Bank located inside the Kyle H-E-B and admitting to asking a woman in the parking lot for directions, the affidavit said. The suspect then denied any further contact with the victim, but later changed his story and admitted to “touching victim on her left arm,” the affidavit said.

De Los Santos remains in the Hays County Jail and is being held on a $75,000 bond.
