A zoning case for 12.88 acres of a 46.15 acre tract will start over after an error was discovered in notifying property owners on a proposed “mixed use” zoning request.
The City of San Marcos has determined that not all property owners were notified in compliance with state law for the zoning of 12.88 acres as part of redevelopment of the Buie Tract.
The zoning case will start over with consideration at the Planning and Zoning Commission on May 25.
The remaining land use and zoning decisions made by the city council on May 4 stand approved unless reconsidered at the May 18 City Council meeting.
Through a computer error, the city’s 2009 tax roll did not pick up several parcels that had changed hands from the original owners.
When the error was verified late Wednesday, the city invalidated the original proposed mixed use zoning and required the developer to begin the process over again.
City staff manually checked the other parcels with the 2009 certified appraisal roles and they were found to be in compliance with state notification requirements, with all property owners properly notified.Email | Print
