A San Marcos woman is in custody at the Hays County jail after police say she accidentally ran over her boyfriend early Wednesday morning.

Elizabeth Ann Buchanan, 21, awaits magistration on charges of intoxication manslaughter, a second-degree felony.

Police say that Buchanan and her boyfriend, Joshua Gabriel Horn, 33, were drinking at a local bar late Tuesday night and had a disagreement. Horn then walked back to their residence on Sagewood Trail.

According to police, Buchanan drove back to their residence early Wednesday morning and accidentally ran over Horn in the driveway. Buchanan immediately called 911 and attempted life saving measures until emergency personnel arrived and took over. Police believe Horn was either sitting or lying on his stomach in the driveway, and that the incident was accidental.

Police officers were dispatched to the residence at 2:05 a.m. San Marcos fire and EMS personnel provided cardio-pulmonary rescuication, but the victim was pronounced deceased at the scene by Hays County Justice of the Peace Jo Anne Prado.

Intoxication manslaughter carries a penalty of two to 20 years in prison and up to a $10,000 fine. Neither Buchanan nor Horn are current Texas State University students, city spokesperson Trey Hatt said.
