KYLE – Kyle police have arrested a man they believe fired at least one shot at firefighters early today in the Sunset Ridge mobile home park.
Jason Montalvo, 18, is charged with assault on a public servant, a third-degree felony punishable by two to 10 years in prison.
Shortly after 1 a.m. Monday, April 14, the Kyle Fire Department was called out to 390 Buggy Whip Drive where they found a storage shed on fire. After the fire was extinguished, firefighters said they heard at least one gunshot — possibly more — striking a wall behind them, said Jerry Hendrix, the city of Kyle’s spokesperson.
Kyle police determined that the gunfire had come from a nearby residence at 928 Harvest Moon Pkwy. Inside, police found Montalvo asleep in his bed with a rifle at his side.
When officers awakened Montalvo, he “became combative and refused police commands to surrender the rifle,” Hendrix said. He was subdued with a Taser and then arrested.
Montalvo is being held at the Hays County jail in San Marcos. In addition to the assault on a public servant charge, he has an outstanding arrest warrant from Travis County for marijuana possession, Hendrix said.
