A Hays County jury sentenced San Marcos resident Roger Reyes, 40, to life in prison without possibility of parole after convicting him Tuesday of continuous sexual abuse of a young child.

The jury also convicted Reyes of one count of sexual performance by a child and ordered him to serve 50 years on that charge.  The sentences will run concurrently.

Trial testimony revealed that Reyes molested a step daughter during a period of months during 2007 and 2008. At times, Reyes used ligatures to restrain the girl.

Reyes had married the girl’s mother following his release from prison, where he had served time for kidnapping and attempting to rape a 16 year-old Bexar County girl. That victim testified against Reyes at the Hays County trial, saying he tied her up “like an animal” and dragged her into his apartment.

“Our office is extremely grateful to the 12 jurors and 2 alternates for their service in this case,” Hays County District Attorney Sherri Tibbe said. “This was a difficult case that dealt one of the most heinous acts a criminal defendant can commit. We commend their service and dedication in seeing that justice was served for Roger Reyes’ victims and the citizens of Hays County.”

The trial was the first in Hays County on a count of continuous sexual abuse of a young child. The legislature passed the new designation, allowing that it is difficult for children who have been abused continuously for 30 days or more to recall enough details of specific episodes to meet the requirements for conviction under other statutes.

Hays County Assistant District Attorney Cathy Compton praised the new statute as an effective tool in prosecuting child sexual abuse cases and said she plans to charge additional cases under the new statute when appropriate.
