Charges against accused parents dropped

EDITOR’s NOTE: The following release — put out this Friday afternoon like all news authorities don’t want getting much attention — brings to a close charges against two parents accused of killing their two-month-old child in March 2006. I have followed this case closely since its start — the contradictory autopsies, the destroyed evidence, the steadily downgraded charges. From the Hays County District Attorney

The Hays County District Attorney’s Office has reluctantly decided to file motions to dismiss pending cases for Injury to a Child on Esther and Cipriano Gonzales.

The cases involved allegations that the couple caused the death of their two-month old daughter, Cynthea Gonzales, in March of 2006. The motions were filed after the District Attorney’s Office confirmed crucial forensic evidence, outside the control of the San Marcos Police Department and the District Attorney’s Office, could not be located.

While this office is convinced that Cynthea Gonzales did not die as a result of a natural or unexplained cause, the experts involved in this case have substantial differences of opinion as to the cause of death.

“In my experience as a prosecutor, this is one of the most difficult decisions that I have had to make. However, the rule of law and my ethical obligations require that we not proceed with this case at this time. I ask that everyone remember the victim in this case, 2 month old Cynthea Gonzales,” said Sherri Tibbe, Criminal District Attorney.

The statute of limitations for this type of case would allow for charges to be brought at a later date if circumstances change or someone comes forward with new evidence in the case.

  1. Evidence could not be located? What is the risk of this happening again? What punishment is being considered for those responsible? I want to know what happened!
