The stepfather of a two year old boy who suffered a fractured skull last week has been arrested and charged with felony injury to a child / serious bodily injury.

Adrian Alvarez Rodriguez, 29, was taken into custody Thursday by San Marcos Police and jailed at the Hays County Law Enforcement Center. Bond was set at $75,000.

The parents of the two year old, whose name was not released, took him to Central Texas Medical Center Friday night, Feb. 22, 2008, after the child began convulsing and vomiting, police said. He was transported by helicopter to Dell Children’s Hospital in Austin where he underwent emergency surgery for a fractured skull. The child remains in intensive care.

The boy had been in the care of Rodriguez, his stepfather, while the mother was at work and a sister was at school, said police.

According to Det. Scott Johnson, doctors were suspicious of Rodriguez’s explanation that the boy was injured when he fell while playing outside. Police said Rodriguez’s account of the incident changed during later police interviews.

Justice of the Peace JoAnne Prado issued an arrest warrant for Rodriguez Thursday and he was taken into custody by San Marcos Police.

The case continues under investigation.
